Ben & Jerry's sued over Chunky Monkey
Friday 18 May, 2007
Ben & Jerry's, a manufacturer of premium ice cream products is to be sued by the daughter of the Chunky Monkey's artist.
Although the character has been used by Ben & Jerry's since 1988, the lawsuit centres around allegations that the company violated agreements with the original artist by printing "misleading" information about the character's origins and by using Chunky for the promotion of lip balm, reports the Toronto Star.
The character was created in 1973 by Pauline Comanor; before passing away in 2005, Ms Comanor resolved a number of trademark disagreements with the manufacturer.
Featuring a number of ingredients, including bananas, fudge and walnuts, Ben & Jerry's Chunky Monkey ice cream holds third place in the company's top ten list of flavours, with first place going to Cherry Garcia.
The company has so far been unavailable for comment.
